General Terms and Conditions (GTC)

§ 1 Scope and Contracting Party
1.1 These General Terms and Conditions (GTC) apply to all contracts concluded via the online shop at www.sirius-vibrations.com between Sirius Vibrations, Dirk Schulz, Landwehrstr. 24, 64760 Oberzent-Rothenberg, Germany (hereinafter "Provider") and consumers within the meaning of § 13 of the German Civil Code (BGB).
1.2 Any deviating terms and conditions of the buyer are hereby expressly rejected. They shall not become part of the contract even if the Provider does not separately object to them.
1.3 A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed in nature.
§ 2 Conclusion of Contract
2.1 The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order (invitatio ad offerendum).
2.2 By clicking the order button ("Buy Now" / "Add to Cart" and subsequently "Submit Order"), the buyer submits a binding offer to purchase. The contract is concluded as soon as the Provider accepts the order by sending an order confirmation by email or by dispatching the goods.
2.3 The contract language is German.
2.4 The full contract text is not stored by the Provider. The buyer may save the contract text before submitting the order using the browser's print function. After the contract is concluded, the order data and these GTC will be sent by email.
§ 3 Prices and Payment
3.1 All stated prices are gross prices including statutory VAT. Shipping costs are not included in the purchase price and will be shown separately during the ordering process.
3.2 The following payment methods are available:
Credit card (Visa, Mastercard)
Apple Pay
Instant bank transfer (Sofortüberweisung)
Advance payment / bank transfer
3.3 For advance payment, the amount must be transferred within seven working days of receipt of the order to the account stated in the order confirmation. In the event of default, the Provider is entitled to withdraw from the contract.
3.4 When processing payments via third-party providers (credit card, Apple Pay, instant transfer), the respective terms and conditions of the payment service provider apply in addition.
§ 4 Delivery and Shipping
4.1 Delivery terms and delivery times are stated in the respective product description.
4.2 For consumers, the risk of accidental loss or deterioration of the goods passes to the buyer only upon handover of the goods to the buyer, regardless of whether the shipment is insured or not.
4.3 Deliveries are made within the EU. For deliveries outside the EU, additional import duties and taxes may be charged in the destination country, which are to be borne by the buyer.
§ 5 Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the withdrawal form available at www.sirius-vibrations.com/widerruf, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
5.1 The withdrawal period begins on the day on which the buyer or a third party named by the buyer (not the carrier) takes possession of the goods.
5.2 To exercise the right of withdrawal, a clear declaration (letter, email) to the following address is sufficient:

5.3 Return costs: The direct costs of returning the goods are borne by the buyer. In the case of an exchange, the Provider bears the shipping costs of the replacement delivery.
5.4 Compensation for diminished value: The buyer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. Used tuning forks or sound instruments may be subject to a corresponding deduction for diminished value.
§ 6 Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to:
Goods made to the consumer's specifications or clearly personalised (§ 312g para. 2 no. 1 BGB)
Sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery
Digital content (audio downloads, PDF documents, video courses) if the Provider has begun performance with the buyer's prior express consent and the buyer has confirmed knowledge that the right of withdrawal is lost once download has commenced or access has been granted (§ 356 para. 5 BGB)
§ 7 Special Conditions for Digital Products
7.1 Digital products (audio downloads, e-books/PDF, online courses, digital vouchers) are made available for download or access is granted after full payment has been received.
7.2 The buyer agrees before completing the purchase that the Provider will begin performance of the contract immediately, and confirms awareness that the right of withdrawal is lost once the download begins or access is granted.
7.3 The buyer is granted a simple, non-transferable right of use for private, non-commercial purposes. Passing on, reproduction, editing or public disclosure of digital content is not permitted without the express written consent of the Provider.
7.4 The technical requirements for accessing digital content (e.g. compatible playback devices, internet connection) are the responsibility of the buyer.
§ 8 Retention of Title
The delivered goods remain the property of the Provider until the purchase price has been paid in full.
§ 9 Statutory Warranty
9.1 Statutory warranty rights apply. The limitation period for warranty claims for new goods is two years from delivery.
9.2 The buyer is requested to inspect the goods upon delivery for completeness, obvious defects and transport damage, and to notify the Provider of any defects without delay. Failure to do so does not affect the buyer's statutory warranty rights.
9.3 Natural material properties are deemed agreed characteristics and do not constitute a defect, provided they are indicated in the product description. This applies in particular to:
Wood products: grain, colour tone, minor surface irregularities
Gemstone spheres: As each sphere is a natural product, the Provider selects the specific sphere at their own discretion from the available stock. Variations in colour, pattern, inclusions and transparency compared to product photos are inherent to the material and do not constitute a defect. Selection is made with care in line with the respective stone quality.
9.4 In case of problems, the buyer should contact the Provider directly first, not the payment service provider.
§ 10 Liability
10.1 The Provider is liable without limitation for damages arising from injury to life, body or health, as well as in cases of intent and gross negligence.
10.2 In the event of slightly negligent breach of material contractual obligations (cardinal obligations), liability is limited to the foreseeable, contract-typical damage.
10.3 Any further liability for slightly negligent breaches of duty is excluded.
10.4 The above limitations of liability do not apply where defects have been fraudulently concealed or a guarantee has been given for the quality of the goods.
10.5 The Provider's products, in particular V.I.B.E. tuning forks and sound instruments, are designed for use in the field of sound and frequency work. They do not replace medical or therapeutic treatment. The Provider accepts no liability for damages resulting from misuse, improper application or failure to follow product instructions. Where known health conditions exist, the responsibility for assessing the suitability of the product lies with the buyer.
§ 11 Privacy
The processing of personal data is carried out in accordance with the Provider's privacy policy, available at www.sirius-vibrations.com/datenschutz. This policy forms part of these GTC.
§ 12 Dispute Resolution
12.1 The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr
12.2 The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 13 Governing Law and Jurisdiction
13.1 The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
13.2 For consumers, the above provisions apply only insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
13.3 The place of jurisdiction for merchants and legal entities is Michelstadt, Germany. For consumers, the statutory place of jurisdiction applies.
§ 14 Final Provisions
14.1 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory regulation.
14.2 Amendments or additions to these GTC require the text form.
